Terms and Conditions
The use of this site is governed by, among other things, the policies, terms and conditions set forth below. Please read them carefully. You indicate that you accept these terms and conditions by doing any one or more of the following: 1) using this site; 2) placement of an order and/or 3) submitting a purchase order to the METAmessage Custom eStore, powered by METAmessage. These terms and conditions shall supercede any subsequent terms or conditions included with any purchase order, whether or not such terms or conditions are signed by METAmessage or METAmessage, METAmessage or METAmessage reserves the right to make changes to this site and these terms and conditions at any time.
1. Limitation of Liability. METAmessage and Onset Technology total liability, whether for breach of contract, warranty, negligence, strict liability in tort or otherwise, is limited to the price of the particular products sold under these Terms with respect to which losses or damages are claimed. In no event will METAmessage or METAmessage be liable for any loss of use, loss of time, inconvenience, commercial loss, lost profits or savings or other incidental or consequential damages to the full extent such may be disclaimed by law. No action will be brought for any breach of these Terms more than one year after the accrual of such cause of action. You agree that this limitation of liability is comprehensive and applies to all damages of any kind, including without limitation direct, indirect, compensatory, special, incidental, punitive and consequential damages. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to Buyer.
2. Return Policy. METAmessage customers wishing to return a downloaded software product within 30 days of purchase must send a written email request to support@METAmessage.com, or a signed fax to +1-831-471-1364 (for legal purposes). The Buyer must include First Name, Last Name, Email Address, and Account Number in the request. To obtain a replacement or a refund of a defective downloadable product within 30 days of download, the Buyer must submit a written request via email or fax as specified above. Once METAmessage has received and processed the Buyer's request, a refund confirmation will be sent by e-mail.
Each user is fully responsible for paying all monies owed to the Company. In respect of any payment made by you, you agree that you will not make any charge-backs, and/or deny or reverse any such payment and will reimburse the Company for any charge-backs, denial or reversal of payments you make and any expense incurred or loss suffered by the Company as a consequence. The Company may, at its sole discretion, cease to provide the Service and/or demand payment as aforesaid from any such user.
3. Indemnity. The consumer should be aware that the products and sites listed at METAmessage.com have been provided by parties other than METAmessage, Inc. with the exception of any product branded "METAmessage" in the title. With the exception of products found in METAmessage Software Suites and other METAmessage-branded titles, METAmessage has not tested, certified, or validated any software found on these sites and therefore cannot make any representations regarding the quality, safety, or suitability of any software found there. METAmessage will make every reasonable effort to monitor products; however, you are solely responsible for any repercussions resulting from the use of any software and METAmessage will not be liable for any damages resulting from the use, modification, or distribution of any software. Any questions, complaints, or claims related to specific software titles should be directed to the appropriate party, which METAmessage will provide upon request.
